Consumer Protection Act 2019 : Demystifying the myth

After the changes made in the Consumer Act by the government, there have been many essential changes in the officers given to the customers, and since then, the consumer has become the king.  Also, those showing exaggerated advertisements are no longer well, and now there is a provision for installment action against such companies.  At the same time, e-commerce companies have also been strictly shown in the new consumer law.

The consumer gets Six rights - Under the new Consumer Protection Act 2019, customers get the right to protection. 

  • Under this, the customer can protect himself or his property by marketing goods or services. 
  • Under the new law, customers have full rights to get information about the quality, quantity, purity, and price of any product.
  •  In the new law, the customers get the right to make any variety of goods and services available to them so that they can sort the services and goods according to their own.
  •  Under the new law, customers can file a complaint in the forum regarding any product, service, and advertisement.
  •  Under the new law, customers can complain about any unfair practice.

 Apart from consumer courts, there is also a provision for the Central Consumer Protection Authority to settle customer complaints in the new law.

Punishment and fine

Under the new Consumer Protection Act, there is a provision to keep strictness against adulterated, fake products. 

If there is no loss to the consumer due to the adulterated goods, then there is a provision of a fine ranging from 6 months to 1 lakh for the manufacturer and seller.

If the consumer is harmed due to the adulterated article, the manufacturer, seller or distributor can be punished with a fine of up to Rs 5 lakh and a jail term of up to 7 years.

If the consumer is killed due to adulterated goods, the fine can be up to Rs 10 lakh and imprisonment for seven years.

E-commerce companies are also in scope.

 Under the new law, e-commerce companies have also been included in the purview of this law.  If any e-commerce company cheats on the customers, they can complain against them, and customers can complain to the District and State Consumer Commission of the home state.  Online and teleshopping companies have been included in consumer law for the first time.  At the same time, this thing has also been identified in the new law, under which action will be taken on complaints of taking more money on food items in multiplexes.
